This Acceptable Use Policy ("AUP") defines the rules and restrictions governing the use of the cloud-based messaging services, APIs, and SMS gateway solutions provided by BlackSMS ("we," "our," or "us"), hosted at https://blacksms.in. By registering an account or using our services, you agree to abide by all terms outlined herein.
1. Permitted Use
Our services are strictly intended for legitimate businesses, registered startups, licensed developers, e-commerce platforms, fintech entities, and enterprises. Customers must use BlackSMS only for lawful business communication where recipients have provided explicit opt-in consent, or where there is a pre-existing transactional relationship under applicable local laws, including TRAI guidelines.
2. Prohibited Messaging & Content
You are strictly prohibited from using the BlackSMS network, services, and APIs to transmit, distribute, or facilitate any content that is illegal, harmful, or abusive. Prohibited use cases include, but are not limited to:
- Spam and Unsolicited Messaging: Sending commercial messages without documented recipient consent.
- Fraud & Deceptive Scams: Messages that mislead recipients, mimic reputable entities, or promote quick-wealth schemes.
- Phishing & Social Engineering: Messages designed to trick recipients into revealing sensitive data, credentials, or financial info.
- Illegal OTP Usage: Sending One-Time Passwords (OTPs) for unlicensed platforms, fake registrations, or unauthorized access attempts.
- Loan & Financial Scams: Unregulated lending services, unauthorized credit offers, and predatory loan recovery harassment.
- Adult & Explicit Content: Promoting pornographic material, adult chat services, or sexually explicit content.
- Gambling & Betting Promotion: Messages promoting online casinos, betting platforms, sports betting apps, or lottery schemes not registered or licensed under local jurisdictions.
- Cryptocurrency Promotion Abuse: Unlicensed crypto alerts, illegal token offerings (ICOs), and speculative trading schemes.
- Fake Marketing Claims: Distributing messages with false, misleading, or deceptive advertising statements.
- Hate Speech & Harassment: Content that threatens, defames, or incites violence against individuals or groups.
3. Regulatory & DLT Compliance
For all messages terminated within India, customers must comply with the Telecom Regulatory Authority of India (TRAI) rules:
- DLT Registration: You must register your Principal Entity (PE), Header (Sender ID), and Content Templates on an authorized DLT portal.
- Template Matching: Messages sent through our API must strictly match approved DLT templates. Any mismatch will lead to immediate gateway blocking.
- Scrubbing & Opt-outs: Promotional messages must undergo DND (Do Not Disturb) database scrubbing.
4. Monitoring, Auditing & Suspension
BlackSMS reserves the right to monitor account activity, traffic patterns, and content logs to ensure compliance. We may audit customer opt-in records, DLT registrations, and business legitimacy at any time. Violations of this AUP will result in immediate, temporary, or permanent suspension of your account and API access, without prior warning and without any liability for refund.
