Anti-Spam Policy

BlackSMS ("we," "our," or "us"), operating at https://blacksms.in, maintains a strict, zero-tolerance policy regarding unsolicited text messages (commonly referred to as "spam"). All customers using our cloud communication gateway, APIs, or reseller panels are bound by this Anti-Spam Policy.

1. What is Spam?

Under this policy, spam is defined as any mobile text message (SMS), multimedia message (MMS), or notification sent to an individual who has not provided explicit, verifiable consent to receive such communications from the sender. This includes promotional offers, updates, transaction notifications, or marketing claims sent to purchased, leased, or scraped contact lists.

2. Mandatory Recipient Consent

To send messages through our platform, you must satisfy the following consent requirements:

  • Explicit Opt-in: Recipients must have actively requested to receive messages from your business (e.g., through a web form check-box, a written agreement, or double opt-in validation).
  • No Purchased Lists: You may not upload or send messages to contact lists obtained from third parties, even if they claim the list is opt-in.
  • Opt-out Mechanisms: All promotional messages must contain a clear, functional way for the recipient to opt-out of future messages (e.g., "Reply STOP to cancel" or a DLT-approved opt-out mechanism).

3. Indian TRAI & DLT Compliance

Under the Telecom Regulatory Authority of India (TRAI) guidelines:

  • DND Scrubbing: All promotional campaigns must be automatically or manually scrubbed against the National Customer Preference Register (NCPR) or Do Not Disturb (DND) database, unless the customer holds an active, DLT-registered consent template from the recipient.
  • Hours of Operation: Promotional SMS campaigns can only be transmitted between the hours of 9:00 AM and 9:00 PM local time (IST). Transactional and OTP messages are exempt from this time window.
  • Traceability: Every message header (Sender ID) must be linked to a verified entity on the TRAI Distributed Ledger Technology (DLT) database.

4. Monitoring, Audit, and Enforcement

We utilize automated heuristic filtering to scan outbound SMS traffic for spam indicators, prohibited keywords, template mismatches, and high recipient complaint rates. We reserve the right to audit your consent documentation at any time. You must produce verifiable proof of consent for any recipient within 24 hours of our request.

5. Penalties for Violations

If we detect spamming activity or receive valid complaints from telecom operators or regulatory bodies (such as TRAI):

  • Your BlackSMS account and API keys will be immediately suspended.
  • Any remaining prepaid SMS credits will be forfeited as liquidated damages.
  • We will report the infraction, along with your verified corporate details, to regulatory authorities and partner telecommunication carriers for listing on their national spammer registries.

6. Reporting Abuse

If you have received an unsolicited SMS that appears to originate from our gateway, please forward the message details, sender identifier, and date to [email protected] so we can investigate and block the offending account immediately.

Disclaimer: Compliance with the Anti-Spam Policy is mandatory. Violations are punishable by network disconnection, financial penalties, and legal action in accordance with the Information Technology Act, 2000, and TRAI TCCCPR guidelines.
