Cancellation Policy

This Cancellation Policy outlines the procedures, terms, and conditions under which a customer may cancel their account, subscription, or services with BlackSMS ("we," "our," or "us"), available at https://blacksms.in.

Forfeiture of SMS Credits

All remaining prepaid balances, SMS credits, and active plans are immediately forfeited upon account cancellation. No financial credits or refunds are issued.

1. Customer-Initiated Cancellation

If you wish to close your BlackSMS account, you can do so by submitting an official request through your customer dashboard or emailing our support desk at [email protected]. Please note:

  • Verification: Cancellation requests must originate from the registered primary administrator email address associated with your account.
  • Outstanding Balances: All outstanding API usage fees, postpaid charges, or recurring balances must be fully paid before the cancellation request can be processed.
  • Effect of Deactivation: Once deactivated, all API keys, webhook configurations, DLT linkages, and custom sub-accounts associated with your profile will be permanently disabled.

2. Subscription and Recurring Plan Cancellations

If you have subscribed to a monthly/annual recurring subscription or API access tier, you may cancel your subscription at any time prior to the next billing cycle. The cancellation will take effect at the end of the current billing cycle, during which you will retain access to the services. To prevent automatic renewal, cancellations must be completed at least 48 hours before the next billing renewal date.

3. Provider-Initiated Cancellation (Termination)

BlackSMS reserves the right to suspend, terminate, or cancel your account and access to our SMS gateway services unilaterally under the following conditions:

  • Material breach of our Acceptable Use Policy (AUP) or Anti-Spam Policy.
  • Failure to complete KYC verification requirements.
  • Failure to pay outstanding service invoices or payment chargebacks.
  • Directives from regulatory authorities (such as TRAI, DoT) or network operators.

In the event of provider-initiated cancellation due to policy violations, all prepaid credits are forfeited, and the customer remains liable for any pending balances.

4. Data Retention Post-Cancellation

Following account cancellation, BlackSMS will retain KYC records, payment history, and message transmission logs for a period of up to 1 year, or as required under applicable telecom regulations and Indian law, for audit, compliance, and law enforcement purposes.

Disclaimer: Cancellation requests cannot be reversed once finalized. BlackSMS does not guarantee data recovery or DLT config retention for deactivated accounts.
