This Compliance & Regulatory Policy outlines the legal structure governing commercial and transactional SMS termination in India.

1. Regulatory Framework: TRAI & TCCCPR 2018

All A2P (Application-to-Person) messages terminated on telecommunication networks in India are governed by the Telecom Regulatory Authority of India (TRAI) under the Telecom Commercial Communications Customer Preference Regulations, 2018 (TCCCPR). These regulations are designed to curb unsolicited commercial communication (UCC) and protect mobile subscribers from spam, phishing, and scam messages.

2. Distributed Ledger Technology (DLT) Requirements

To send any SMS via BlackSMS, every commercial entity is legally required to register on a cellular operator's Distributed Ledger Technology (DLT) platform (such as Jio, VIL, Airtel, BSNL, or Tata). You must comply with the following DLT mandates:

  • Principal Entity (PE) ID: A unique registration number assigned to your business. This must be verified on our platform before API activation.
  • Header/Sender ID Registration: Headers (6-character alpha/numeric identifiers) must be registered under your PE ID and approved by telecom operators.
  • Content Template Registration: Every message script must be registered, approved, and associated with a unique DLT Template ID.
  • Dynamic Parameters: Variable placeholders in DLT templates (such as {#var#}) must be populated only with logical, legitimate transactional details (e.g., OTP codes, account balances, invoice numbers). They cannot be exploited to insert unauthorized promotional text.

3. Prohibited Use and Penalties

We prohibit any bypass of regulatory controls. Violations that attract immediate account suspension and carrier penalty pass-throughs include:

  • Sending commercial messages under the guise of transactional headers (transactional header abuse).
  • Distributing promotional content during prohibited hours (9:00 PM to 9:00 AM IST).
  • Using unapproved templates or spoofing approved DLT headers.
  • Transmitting fraudulent links, phishing attempts, or illegal loan/cryptocurrency marketing.

4. Monitoring, Audit & Compliance Enforcement

BlackSMS operates continuous validation layers that cross-reference all outbound API payloads with DLT database registries. We reserve the right to audit your regulatory compliance records, recipient database opt-ins, and DLT registration certifications at any time. Non-cooperation with audits will result in immediate API blocking.

5. Trai Penalties and Indemnification

Any penalty, fine, or regulatory surcharge levied on BlackSMS by the Telecom Regulatory Authority of India (TRAI), telecommunication operators, or law enforcement bodies due to unauthorized, fraudulent, or non-compliant traffic generated from your account will be billed directly to you. You agree to fully indemnify and hold BlackSMS harmless against all such claims, damages, and legal costs.

Disclaimer: Regulatory compliance is mandatory under Indian law. BlackSMS is legally obligated to share customer data, traffic logs, and registration documents with TRAI, the Department of Telecommunications (DoT), or any law enforcement agency investigating commercial communication abuse.
