To maintain our reputational standing with cellular carriers, comply with payment gateway compliance standards (including Stripe, Razorpay, Cashfree, and banks), and satisfy TRAI requirements, BlackSMS ("we," "our," or "us"), available at https://blacksms.in, maintains a strict Prohibited Businesses list.

1. Prohibited Industries & Business Models

The following sectors and entities are strictly barred from registering, creating an account, or sending messages through the BlackSMS gateway API:

• Adult & Sexually Explicit Services: Adult entertainment, pornography, escort agencies, webcam shows, and sex toys.
• Unregulated Financial Services: Payday lending, unregulated peer-to-peer (P2P) lending, unauthorized loan collection agencies, and predatory financial services.
• Cryptocurrency & Speculative Assets: Unlicensed token sales, cryptocurrency trading alerts, speculative forex schemes, and get-rich-quick programs.
• Unlicensed Gambling & Betting: Online casinos, sports betting platforms, betting tip services, unregulated lotteries, and fantasy leagues lacking state licensing.
• Illegal Substances & Weapons: Narcotics, prescription drugs sold online without license, tobacco, vaping products, firearms, and weapons.
• Multi-Level Marketing (MLM): Pyramid schemes, network marketing promotions, and chain-letter offers.
• Deceptive & Fake Services: Selling fake social media followers, fake reviews, resume writing scams, and homework helper services.

2. Prohibited Messaging Activities

Even if your primary business is legitimate, you may not use the BlackSMS API or platforms to transmit messages related to:

• Phishing & Account Takeover: Sending links mimicking bank login portals, e-commerce checkouts, or government pages.
• Unauthorized OTP Requests: Utilizing OTP channels to register accounts on behalf of unverified users or system manipulation.
• Scraping & Lead Harassment: Cold-texting mobile numbers compiled from directory scrapers or databases purchased online.
• Deceptive Marketing Claims: SMS advertisements promoting false, unsubstantiated, or misleading medical, financial, or consumer product statements.

3. Account Auditing and Termination

BlackSMS utilizes automated category tagging and manual dashboard reviews to evaluate business validity. If we discover that a client is operating in a prohibited sector or using the API for prohibited messaging, we will immediately freeze the account, terminate the agreement, and forfeit all unused prepaid balances.
